Improper Blood Test: Proper Request
There are specific reasons under the law for requesting and taking a blood test. If these are not followed, the test may be excluded. The officer must have probable cause to arrest a driver for DUI, or in the case of serious injury by vehicle or homicide by vehicle he must have probable cause to search the driver's blood and invoke the implied consent statute. Errors occur, and that can lead to exclusion of a very damaging report from the Division of Forensic Sciences. Click on the link under "Lab Mistakes" to learn more about blood testing.
